Terms of Use

These Terms of Use ("Terms") govern your use of the SpacepadX website and the SpacepadX app for iOS and iPadOS (together, the "Service") operated by SpacepadX, Kin-Yee, and Ho Ye Lam ("SpacepadX", "Kin-Yee", "we", "us", or "our").

The Service is provided by Kin-Yee, with its main office in the Netherlands, registered at the Dutch Chamber of Commerce under 75399423.

Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with these Terms, do not use the Service.

The Service

SpacepadX helps users browse rocket and space launch information, including upcoming launches, recent launches, launch sites, launchpad context, provider and vehicle information, mission details, weather context, webcast links, local reminders, and Calendar event drafts where available.

SpacepadX is planned as a free app. We may add, change, pause, or remove features as the app, API, data sources, and platform requirements evolve.

Launch Information

Space launch schedules can change at any time. SpacepadX presents launch information from external sources through the SpacepadX API, but we do not guarantee that launch dates, times, statuses, launch sites, coordinates, weather context, visibility estimates, media links, webcast links, or related mission details are complete, accurate, current, or available.

Launch times may be tentative, approximate, delayed, scrubbed, or updated by launch providers without notice. You should always verify important launch information with official launch providers, space agencies, range operators, local authorities, and other primary sources before making travel, viewing, safety, business, operational, or time-sensitive decisions.

Not Safety, Travel, or Operational Advice

SpacepadX is an informational app. It is not safety advice, travel advice, operational guidance, aviation or maritime guidance, emergency information, or an official launch authority. Do not rely on SpacepadX as your only source for launch viewing, travel, access, weather, road closures, hazard areas, restricted zones, or any safety-critical decision.

Planning Features

Local reminders, Calendar event drafts, webcast links, and watch options are provided for convenience only. A reminder or Calendar event may not fire if your device settings, notification permissions, operating system behavior, calendar permissions, time zone settings, or app state prevent it.

Calendar events are created only through Apple's Calendar event editor after you confirm the action. You are responsible for checking event details before saving them.

Third-Party Data, Links, and Services

SpacepadX may display or link to third-party launch data, official launch-provider pages, video platforms, map services, media, weather data, analytics, diagnostics, Apple services, and other public resources. Your use of third-party services may be subject to their own terms and policies.

We are not responsible for third-party content, data accuracy, availability, changes, outages, privacy practices, policies, or any consequences of your use of third-party websites, videos, maps, data providers, or services.

Acceptable Use

You agree not to misuse the Service, interfere with the Service, attempt to access non-public systems, scrape or overload the API or website, reverse engineer non-public parts of the Service except where permitted by law, use the Service to violate laws or third-party rights, or use the Service in a way that could harm SpacepadX, Kin-Yee, other users, data providers, or third-party services.

Privacy, Local Data, and Permissions

Your use of the Service is also governed by our Privacy Policy. SpacepadX may store launch data, launchpad data, settings, image cache data, sync metadata, and reminder intent locally on your device. Some features require platform permissions, including notifications, location access, calendar access through Apple's event editor, and network access. You are responsible for managing permissions and local app data on your device.

Proprietary Rights

SpacepadX, the SpacepadX app, website, design, software, graphics, logo, and related materials are owned by Kin-Yee or its licensors and are protected by intellectual property and other laws. We grant you a personal, non-transferable, non-exclusive right to use the Service for its intended purpose, subject to these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the Service except where expressly allowed by law or authorized by us. Third-party trademarks, launch provider names, mission names, vehicle names, images, and media remain the property of their respective owners.

Termination

We may suspend, restrict, or terminate access to the Service at any time if you breach these Terms, misuse the Service, create risk or legal exposure, or if we discontinue part or all of the Service. You may stop using the Service at any time by deleting the app and ceasing use of the website.

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and course of performance.

We do not warrant that the Service will be uninterrupted, secure, error-free, current, or available at any particular time or location, or that launch data, maps, media, notifications, Calendar drafts, weather context, visibility estimates, or third-party links will meet your needs.

Limitation of Liability

To the maximum extent permitted by law, SpacepadX, Kin-Yee, Ho Ye Lam, and our affiliates, suppliers, service providers, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, use, or other intangible losses arising from or related to your use of, or inability to use, the Service.

This includes losses related to inaccurate, incomplete, delayed, changed, or unavailable launch information; missed reminders; missed calendar events; webcast availability; map or location behavior; weather context; third-party data; travel decisions; viewing plans; or reliance on information shown by SpacepadX.

Changes to the Service or Terms

We may modify, replace, or discontinue parts of the Service at any time. We may also update these Terms from time to time. The updated version will be indicated by a new "Last updated" date and will be effective when posted. By continuing to use the Service after changes become effective, you agree to the revised Terms.

Governing Law

These Terms and any non-contractual obligations arising out of or in connection with them will be governed by and interpreted in accordance with Dutch law, without regard to Dutch private international law rules. These Terms do not limit consumer protection rights that you may have under mandatory laws in your country of residence.

Any disputes regarding these Terms will be submitted to the competent court in the Netherlands, except where mandatory consumer law gives you the right to bring a claim elsewhere.
